Scope and acceptance

In plain language: GetTraffic is a business-only (B2B) service. By creating an account or using GetTraffic, you agree to these Terms and confirm you are acting as a business, not a consumer.

These Terms of Service ("Terms") govern your access to and use of gettraffic.ai, our applications, APIs, and related services. By creating an account, accessing, or using the Service, you accept these Terms and our Privacy Policy.

The Service is offered exclusively to businesses (entrepreneurs within the meaning of § 14 German Civil Code / BGB) and not to consumers. By entering into the contract you represent that you act in the exercise of your trade, business, or profession and are authorised to bind the relevant entity. "You" refers to that entity.

Definitions

  • "Content" - website data, product information, keywords, competitor URLs, and other business information you connect to GetTraffic for content generation
  • "AI Output" - SEO articles, content clusters, and marketing content generated by GetTraffic based on your Content
  • "Service" - the GetTraffic platform, website, APIs, and all related functionality
  • "Subscription" - a paid plan giving access to features as described on our pricing page
  • "Merchant of Record" - the third-party reseller that processes payments, invoicing, taxes, and refunds on our behalf. The specific Merchant of Record entity is disclosed at checkout.

Accounts and eligibility

You must be at least 18 years old and have the legal capacity to enter into binding agreements. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at info@gettraffic.ai if you suspect unauthorized access. We may suspend or terminate accounts for misuse, breach of these Terms, or non-payment.

Plans, fees and payment

In plain language: All prices are net plus VAT. There are three plans (Monthly, 12 Months, Yearly). Payments are handled by our Merchant of Record. We give 30 days' notice before price changes, and you can cancel before an increase takes effect.

Current plans and pricing are displayed on our pricing page. All payments are processed by our Merchant of Record, who handles billing, invoicing, sales tax, and VAT on our behalf. The specific Merchant of Record entity will be disclosed at checkout.

Our order process is conducted by our Merchant of Record. The Merchant of Record is responsible for all our orders. The Merchant of Record handles customer service inquiries related to billing and processes refunds.

All prices are net and exclusive of any applicable statutory VAT. We may adjust prices with at least 30 days' written notice before a new term begins; you may cancel before the new term starts.

Plan terms and renewal

The plan you choose determines the term and cancellation:

  • Monthly: no minimum term, billed monthly, cancellable to the end of the current billing month.
  • 12 Months: 12-month minimum term, billed monthly. Auto-renews for successive 12-month terms unless cancelled before the end of the current term.
  • Yearly: 12-month term, paid annually in advance. Auto-renews for successive 12-month terms unless cancelled before the end of the current term.

Cancellation is possible at any time up to the last day of the current term via the billing portal or in text form, and takes effect at the end of the term. There is no fixed notice period. During a running minimum or renewal term, ordinary cancellation with effect before term end is excluded.

Refund policy

As the Service is offered exclusively to businesses, the statutory 14-day consumer right of withdrawal does not apply. Billing and any applicable adjustments are administered by our Merchant of Record in accordance with the terms disclosed at checkout.

Free trial

Where offered, the free trial lasts 7 days. No payment is charged during the trial. At the end of the trial, your account converts to the plan you selected; for minimum-term plans (12 Months, Yearly) the minimum term begins when the trial ends. If you cancel during the trial, no charge is made and no commitment arises.

AI-generated content and intellectual property

In plain language: You own the AI-generated content that GetTraffic creates for you. We do not use your data to train our AI models. You are responsible for reviewing AI output before publishing.

Your ownership of AI Output: All AI Output generated through your GetTraffic account is owned by you. We assign all rights, title, and interest in AI Output to you upon creation.

No training on your data: We do not use your Content or AI Output to train, fine-tune, or improve any AI or machine learning models.

Your responsibility: AI Output may contain inaccuracies. You are responsible for reviewing, editing, and approving all AI Output before publishing. GetTraffic does not guarantee the accuracy, SEO performance, or legal compliance of AI Output.

Third-party AI providers: We use external AI model providers (such as OpenAI and Anthropic) who are contractually prohibited from using your data for their own purposes.

Your content and data

You retain all rights to your Content. By connecting Content to GetTraffic, you grant us a non-exclusive, worldwide license to host, process, display, and transmit your Content solely to provide and improve the Service. This license terminates when you delete your Content or your account.

Data export: You may export your Content and AI Output at any time. After account termination, we retain your data for 30 days to allow for export, after which it is deleted per our retention policy.

Acceptable use

You agree not to:

  • Violate any applicable laws, regulations, or third-party rights
  • Upload or connect illegal, harmful, defamatory, or infringing content
  • Probe, scan, or overload the Service, or bypass security measures
  • Reverse engineer, decompile, or disassemble the Service
  • Use automated tools (bots, scrapers) except through our documented APIs
  • Resell, redistribute, or sublicense the Service without written permission
  • Use the Service to generate content intended to deceive, defraud, or manipulate users or search engines in violation of applicable guidelines

Our intellectual property

We retain all rights, title, and interest in the Service, including its design, code, AI models, algorithms, documentation, trademarks, and branding. You may not use our trademarks without prior written consent.

Service disclaimer: no outcome guarantee

GetTraffic is a software-as-a-service platform that helps customers plan, draft, and publish content. GetTraffic does not guarantee specific search engine rankings, organic traffic volumes, citations by AI search engines or answer engines, or business outcomes.

Search engine and AI-search results depend on many factors outside GetTraffic's control, including but not limited to: content competition in your industry, technical site factors, search engine algorithm changes, AI-system retrieval logic, and your own use of the platform.

Customers retain full control over what is published on their websites. The GetTraffic editor allows review and editing of every article before publication. Customers who configure auto-publish rules retain responsibility for what is published under those rules.

This disclaimer is provided in addition to, not in place of, the Limitation of Liability section below.

Limitation of liability

To the extent permitted by law:

  • We are not liable for indirect, incidental, special, punitive, or consequential damages, including lost profits, revenue, search rankings, or data.
  • Our total aggregate liability is limited to the total fees you paid to us in the 3 months preceding the event giving rise to the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or intentional misconduct.

Term and termination

  • Cancellation by you: The cancellation rules of your chosen plan apply (see "Plan terms and renewal"). Monthly: to the end of the month. 12 Months and Yearly: at any time up to the last day of the current term, effective at term end.
  • Termination by us: We may suspend or terminate your account for material breach, legal risk, or non-payment, with reasonable notice where possible.
  • After termination: You have 30 days to export your data. After 30 days, we delete your data per our retention policy.

Business-only service (B2B)

In plain language: GetTraffic is a business-only service. Consumer-specific protections, such as the 14-day right of withdrawal, do not apply.

The Service is directed exclusively at businesses (entrepreneurs within the meaning of § 14 BGB). Consumer-protection provisions that presuppose a consumer relationship - in particular the statutory right of withdrawal for distance contracts - do not apply. Mandatory statutory rights that also apply between businesses remain unaffected.

Governing law and jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany. For business customers: the courts in Hamburg, Germany have exclusive jurisdiction. For consumers: the mandatory jurisdiction rules of your place of residence apply.

Changes to these Terms

If changes are material, we will notify registered users by email at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance.
